The U.S. Citizenship and Immigration Services published a new version of Form I-9 with minor, nonsubstantive changes. The new I-9 can be used immediately, but prior versions of the I-9 can still be used until they expire, USCIS has announced.

The new version of the Form I-9 carries an edition date of 01/20/25 and an expiration date of 05/31/2027. Two previous editions of Form I-9 (both labeled as edition 08/01/23) remain valid until their respective expiration dates of 7/31/2026 and 5/31/2027.

The changes to Form I-9 align it with statutory language and include an updated DHS privacy notice. The updates include:

  • Changing the fourth checkbox in Section 1 to “An alien authorized to work” from “A noncitizen authorized to work” and
  • In list B, replacing the word “gender” with “sex” in the descriptions for driver’s licenses and government-issued ID cards.

The E-Verify system will also be updated to capture the Section 1 modification, and current E-Verify statuses will automatically be updated from “A noncitizen authorized to work” to “An alien authorized to work.”
