On March 24, President Trump nominated Andrea Lucas, a Republican, to a second five-year term as a Commissioner on the Equal Employment Opportunity Commission.

Ms. Lucas joined the EEOC in 2020 after President Trump nominated her during his first term. He elevated her to Acting Chair of the EEOC at the beginning of his current term in January. If the Senate confirms Ms. Lucas for a second term, she can continue to serve on the Commission until 2030.

Even with her confirmation, however, three of the EEOC’s five commissioner slots would still be vacant. Therefore, the EEOC would still lack the quorum necessary to implement the President’s agenda, such as reconsidering the agency’s Enforcement Guidance on Harassment in the Workplace. It is likely only a matter of time before the White House makes sufficient nominations to give Republicans a majority on the Commission.
