The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has announced its intent to reinstate a revised version of its long-discontinued Form CC-257. If implemented, the revised Monthly Employment Utilization Report will require covered federal construction contractors and subcontractors to report data each month on headcount and work hours by race, ethnicity, sex, and construction trade.
OFCCP stopped using Form CC-257 in 1995 because reviewing the paper reports consumed too many agency resources, OFCCP said in a statement. The agency believes that its burden will be less if the report is reinstated in an electronic format and that the form will help it to protect construction workers.
Under the Paperwork Reduction Act, OFCCP must obtain formal approval from the White House Office of Management and Budget (OMB) to use the CC-257. OFCCP initiated the approval process by publishing the pre-clearance consultation notice in the Federal Register on February 23, 2024.
The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, will file comments on the proposed form if members show interest. Please direct your feedback to Danny Petrella at dpetrella@cwc.org by April 2.
