In light of the Trump Administration’s focus on immigration enforcement, the Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, has updated its guide to I-9 audits and immigration-related workplace raids. CWC’s guide is intended to help members prepare for and respond to audits and workplace raids by the U.S. Immigration and Customs Enforcement (ICE).

The 1986 Immigration Reform and Control Act (IRCA) requires employers to verify the identity and employment authorization of every person they hire by examining documents presented by the individual and recording the information on Form I-9. I-9 audits occur when ICE agents examine the Form I-9s for inconsistencies after issuing a notice of inspection. Employers that fail to complete or properly maintain their forms face fines ranging from $281 to $2,789 per violation. An ICE workplace raid occurs when agents arrive at a workplace without notice to check employees’ work authorization.
