President Trump’s removal of Gwynne Wilcox from the National Labor Relations Board was illegal, a federal court ruled March 6. The U.S. District Court for the District of Columbia declared that Wilcox may be removed as an NLRB member only “upon notice and hearing, for neglect of duty or malfeasance in office, but for no other cause.”

Wilcox, a Democrat, was appointed by former President Biden for a term that expired in August 2028. With her reinstatement, the NLRB will have a quorum of three members (two Democrats and one Republican), so it will be able to resume doing business.

The Trump Administration has appealed the district court decision and asked the U.S. Circuit Court of Appeals for the District of Columbia to prevent Wilcox from serving until it decides the appeal.
