The Center for Workplace Compliance, our affiliated nonprofit membership association, has updated its union notification template to reflect the rescission of E.O. 11246.
CWC members that are federal contractors can use this template to notify covered union officials or employee representatives of the employer’s equal opportunity and affirmative action policies and to request their cooperation. OFCCP regulations implementing Section 503 of the Rehabilitation Act and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act require this communication even though OFCCP never articulated the level of cooperation required of the recipient.
Federal contractors should revise their existing union notification communications if they reference obligations under E.O. 11246. Covered federal contractors may voluntarily comply with OFCCP regulations at 41 C.F.R. Parts 60-1, 60-2, and 60-4 through April 21, 2025.
